Following high-profile maritime disasters in the late 1980s, the maritime industry realized that hardware and structural requirements alone were insufficient to prevent accidents. Human error and poor management were consistently identified as root causes. In response, the International Maritime Organization (IMO) adopted the International Safety Management (ISM) Code in 1993.

The ISM Code's primary objective is to ensure safety at sea, prevent human injury or loss of life, and avoid damage to the environment, particularly to the marine environment and property.

The Safety Management System (SMS)

At the heart of the ISM Code is the requirement for every shipping company to develop, implement, and maintain a Safety Management System (SMS). This is not just a manual on a shelf; it is a living, functional framework that dictates how safe operations are conducted both ashore and aboard the vessel.

Key Elements of an SMS:

  • Safety and Environmental Protection Policy: The company's highest-level commitment to safety and zero pollution.
  • Clear Instructions and Procedures: Documented guidelines detailing exactly how to safely carry out all key shipboard operations (navigation, cargo handling, bunkering).
  • Defined Authority and Communication Lines: Clear hierarchies ensuring everyone knows their responsibilities and who reports to whom.
  • Emergency Preparedness: Procedures detailing how to respond to identified emergency situations (fire, collision, abandon ship).
  • Audits and Reviews: Built-in mechanisms for internal audits, management reviews, and continuous improvement.

The Role of the DPA (Designated Person Ashore)

The ISM Code mandates the appointment of a Designated Person Ashore (DPA). The DPA acts as the crucial link between the ship's crew and the highest level of company management ashore. They must have direct access to the CEO or top management.

If a Master identifies a safety deficiency that cannot be resolved with shipboard resources, or if they lack support from the technical department, they have the right and duty to contact the DPA directly. The DPA is legally responsible for ensuring adequate resources and shore-based support are provided to the vessel.

Master's Overriding Authority

One of the most powerful clauses in the ISM Code is the Master's Overriding Authority. The SMS must explicitly state that the Master has the ultimate authority and the responsibility to make decisions regarding the safety of the crew, ship, and environment, even if those decisions deviate from established procedures or commercial pressures.

If commercial operations threaten the safety of the vessel, the Master is empowered by the ISM Code to halt operations without fear of retribution.

Certificates of Compliance

Compliance with the ISM Code is verified through formal audits, resulting in two key certificates:

  • Document of Compliance (DOC): Issued to the shipping company following a successful audit of their shore-based management system.
  • Safety Management Certificate (SMC): Issued to the individual ship after verifying that it operates in accordance with the approved SMS. The SMC is only valid if the company holds a valid DOC.
